Constitution of the Federated Micronations of Musania
This Constitution was approved by all Member States of the Federated Micronations, both through their Legislatures and a Federation Referendum on 2022.10.03. The new structures and Departments decreed by this Constitution will be presented and introduced over the next few months if they do not already exist today. Preamble
The Federated Micronations of Musania are a Democratic State consisting of Sovereign Member States. Having signed the Chyse Charter, they claim Sovereignty only in their own World and pledge not to come into conflict with governments and their institutions existing on other levels. The values of the Federated Micronations of Musania are based on Human Rights, Climate and Environmental Protection, Scientific Knowledge, Tolerance and Democracy. Name and Flag
The Federated Micronations of Musania may be called "Federated Micronations", "FM" or "Musania" on any official documents. The Flag of the Federated Micronations is rectangular, with a blue triangle at the top, a red one at the bottom, two green ones at the left and right sides and a yellow bar crossing the Flag from bottom left to top right. The Federated Micronations of Musania is a Federation composed of Sovereign States. The founding States are the Balanda Republic, the Republic of Capricornia, the Dershowo Musograd, the Scientific Republic of Murwillumbah and the Repubblica Naquarnia. These States have the unalienable right to leave the Federation if their Citizens decide so with absolute majority in two Referenda at least two years apart. All States send representatives to the Federal Parliament and are represented in the Federal Government. Institutions
The Institutions of the FM are the Federal Government, the Federal Parliament, the Supreme Court of the Federated Micronations, the Joint Sovereign Forces, the State Department and other branches of Government and agencies of the Federation. Federal Government
The Federal Government is responsible for External Affairs, managed by the State Department (SDFM), Defense, represented by the Joint Sovereign Forces of Musania (JSFM), Economy and Trade, managed by the Department of Economy and Trade (DET), Climate and Environmental Protection, managed by the Department of Climate and Environment (DCE), and Communications, Energy, Transportation and Borders, managed by the Department for Infrastructure and Security (DIS). Temporary Federal Administration Clause
In the case of breakdown of the administrative structures of a State, the Federal Government may set up a Temporary Federal Administration in that State. This is to be declared by the Federal Government and countersigned by both chambers of the Federal Parliament. The T.F.A. must slate an Election for a State Constitutional Assembly within 6 months of its declaration, The State Constitutional Assembly has the duty to confirm, amend or rewrite the State constitution or to call for a Secession Referendum. If it is unable to come to any conclusion within one year of its election, the T.F.A. may devolve its powers to the underlaying level of territorial units. The T.F.A. ends when regular elections on the basis of the State constitution have led to the election of a new State Government. Federal ParliamentThe Parliament of the Federated Micronations consists of two chambers:
The Assembly and the Congress elect the Secretary of the Federation by relative majority in a joint session. The Secretary then proposes a Federal Government which has to receive an absolute majority in both chambers. All 5 States must be represented in the Government on the departemental leadership level. Supreme Court
The Supreme Court of the Federated Micronations (SCFM) is composed of two chambers of 11 Judges, half of which are drawn by lot each year from a pool consisting of 100 qualified Judges between one and two years from their lawful pensions age. The States nominate pool members according to the Federation Congress proportional key. The tenure of any Supreme Court Judge may not exceed more than 2 years. Cases are assigned to the chambers by lot if the chambers cannot come to an agreement. Both State Governments, Parliamentarians and Citizens may put a case towards the SCFM if they can conclusively claim that other legal options are not available any more. Defense
The Joint Sovereign Forces of Musania (JSF) are tasked with the defense of the Federated Micronations. For this purpose, the States appoint selected units of their militaries as members of the JSF. The Divisions of the JSF must be composed of Brigades from different States. All other units of the States are tasked with Territorial Defense and are not available for Federal efforts. States may withdraw units from the JSF according to a defined procedure. The JSF also operate Strategic Forces. State Department
The State Department of the Federated Micronations (SDFM) continues to be responsible for International and Intermicronational Relations. Climate and Environmental Protection
Climate and Environmental Protection are highly outstanding goals for the Federated Micronations. The Department of Climate and Environment (DCE) is tasked to manage any activities in these fields, with a superseding power over other Departments in cases of conflicting interests.
